These are the terms that apply when you list and sell tours on Touri. If you have questions, reach us at partners@gotouri.com.
What Touri is — and what it isn't
Touri facilitates you listing your tours, negotiating with travelers, taking bookings, and getting paid by travelers.
We are not your employer, your agent, or your business partner. You run your tours. We run Touri. When a traveler books a tour via Touri, the contract is between you and the traveler directly — Touri is not a party to it.
This means you're responsible for how your tours are delivered, your own taxes and insurance, and complying with local laws.
Who can list on Touri
To list tours you must:
- Be at least 18 years old
- Be legally authorised to offer tours in the places you operate
- Hold Sectur (Mexico City tourism authority) registration if you operate in CDMX
- Hold civil liability insurance that covers your tour activities
- Provide a valid RFC (Mexican tax ID) — guides without RFC are subject to higher tax withholding rates (see Section 6)
- Provide accurate identity information
Your Touri account is personal and non-transferable. You may not transfer, sell, or give access to your account to another person or entity.
We may ask for proof of any of the above at any time. We may suspend any listings until information we ask for is fully provided.
Your listing
Your listing is your responsibility. Everything in it — descriptions, photos, pricing, meeting points, what's included, suitability requirements, age restrictions, and any third-party components (entrance fees, transport, or activities delivered by other providers) — must be accurate and clearly described.
You must keep your availability calendar up to date. Accepting a booking you can't fulfil hurts travelers and the travel community.
We can remove, edit, or suspend listings that we think are misleading, inaccurate, or in breach of these terms. We'll tell you why. For serious issues (safety misrepresentation, illegal content), we can act immediately.
How pricing and commission work
You set your net price — the amount you want to receive for a tour. Touri adds a commission on top, and that’s the price the traveler sees and pays. You’ll always see prices net of our commission, so any offer you see or make is the amount you’ll get - nothing extra taken off for commission. We handle the math for you, so you never have to deduct from an offer you see, or add extra to the amount you counter.
Your commission rate is set out in an email we send before your first listing goes live. If we want to change the commission rate for your tours, we’ll give you 30 days’ notice before any increase. If you don’t like the new rate, talk to us, and if you need, you can also close your account before it takes effect. Your confirmed bookings made before any rate change always keep the old rate.
When you get paid: We release your payout 24 hours after the tour date. This short hold period lets us deal with any cancellations or complaints before funds are transferred.
Payout deductions: Before we send your payout, we deduct: our commission, applicable Mexican tax withholding (IVA and ISR), and any payment processing fees. You'll get a payout statement showing exactly what was deducted.
Cancellations: If you cancel a booking, you receive nothing and the traveler gets a full refund. If Touri cancels a booking (e.g., due to a platform error), the traveler receives a full refund and you'll receive any payout owed for completed tours.
Disputes: We may hold your payout while we investigate traveler disputes. We aim to resolve disputes within 30 days.
Cancellation policy
| Who cancels | When | Traveler refund | Your payout |
|---|---|---|---|
| Traveler | 48+ hours before tour | 100% | 0% |
| Traveler | 24–48 hours before tour | 50% | 50% of net (minus tax) |
| Traveler | Under 24 hours before tour | 0% | 100% of net (minus tax) |
| You (guide) | Any time | 100% | 0% |
| No-show by you | — | 100% | 0% |
If you cancel more than twice in any 60-day period without a valid reason (illness, emergency, force majeure), we may impose a cancellation fee or place your account under review.
Taxes — what Touri withholds
Mexican law requires us to withhold VAT (IVA) and income tax (ISR) from your payouts and remit them to SAT on your behalf.
| Your situation | IVA withheld | ISR withheld |
|---|---|---|
| You provide a valid RFC | 8% of pre-tax payout | 0.4%–10% (by income) |
| No RFC provided | 100% of IVA | Up to 20% |
Each month we'll issue a CFDI (tax receipt) documenting withholdings. We may update rates when the law changes. This is not a change to your commission rate.
Insurance
You must hold civil liability insurance covering your tour activities for as long as you're listed on Touri. This is a legal requirement in Mexico City.
We'll ask for proof at onboarding and periodically. If you can't show valid coverage, we'll suspend your listings. Your insurance is your responsibility.
How you must behave on platform
- Treat travelers well. No discrimination, harassment, or threatening behaviour.
- Be honest. Don't misrepresent qualifications, experience, or what a tour includes. Suitability requirements, age restrictions, and third-party components must be clear.
- Deliver what you promised. Show up, start on time, and run the tour as described.
- Privacy. Use traveler contact info only to coordinate the booked tour. Don't add them to mailing lists.
Reviews
Travelers can leave reviews after tours. Do not solicit fake reviews, offer incentives for good reviews, or pressure travelers to change or remove reviews. We may remove reviews we think are fake or abusive.
Your data and traveler data
We use your personal data to run the platform, process payouts, and meet legal obligations (SAT). Traveler contact information shared for coordination must be kept confidential and deleted within 30 days of the tour.
Suspension and termination
We can suspend or close your account for breaches of these terms, credential lapses, or with 30 days' notice for any other reason. For serious issues like fraud or harassment, we can act immediately without notice.
Changes to these terms
We can update these terms at any time. For commission increases, we give 30 days' notice. Continued use of the platform after the effective date means you accept the updated terms.
Liability
You're responsible for your tours. You agree to indemnify Touri against claims arising from your conduct. Touri's liability for anything that is our fault is capped at the total commission paid by you in the preceding 6 months.
Disputes
Try support first: partners@gotouri.com. If unresolved, disputes go to binding arbitration under UNCITRAL rules, administered by CANACO, seated in Mexico City, conducted in Spanish. These terms are governed by the laws of England and Wales.
